Is this the reference in the second point in the letter that a “materially identical rezoning request was denied…” as a claim of violation of their due process rights?

Saw that previously….thought to myself why would David Knight who previously lost to Christina Jones to the Livable crew’s glee, be involved in this suit…..? And, then promptly was distracted by something else. Now, I’m again curious…..

While I’m not holding my breath for this to happen in my lifetime, imagine their rage when any changes come to the tracks and new stations for high speed rail.

Kevin Hornik of Brough Law Firm, representing the plaintiffs in the suit, said the three neighbors — Roy Attride III, Connie Upchurch and David Knight — represent the “interests of many residents within the Glenwood-Brooklyn Historic District and surrounding area.”

“They support responsible development on these parcels and would welcome an appropriately designed project, consistent with the policies and intent of the 2030 Comprehensive Plan and sound urban-planning principles. They are also committed to ensuring that any development mitigates its impacts on the surrounding homes and the character of the historic neighborhood,” Hornik said.

Residents of the neighborhood have said a high-rise building would, literally, cast a shadow on their homes.

The lawsuit states the plaintiffs will “suffer a decrease in property values, an increase in vehicular traffic, an increase in crime, an increase in noise and light pollution, an increase in glare and a decrease in sunlight that is unsurpassed and unique in the community.”

Increase in vehicular traffic is a stretch. Half the neighborhood dead ends into railroad tracks.

There is literally nothing that could be built there within the zoning that would decrease their property values.

Let’s remember what’s being redeveloped…. This isn’t going to tear down historic home but dilapidated looking commercial buildings. These people are nuts

So far 43 have donated on average $644 for a total of almost $28K. It isn’t chump change but I doubt it will cover all they need for an attorney these days. I would say they are kinda worked up over the fact that they now live in the city where shadows exist and more people are moving in. Sigh.
